360° WORKPLACE SAFETY
What is workplace safety?
Occupational Safety means the Employer's implementation of all technical, organizational, and procedural measures aimed at protecting workers and all others working in company areas, as well as the surrounding environment.
The aim is to protect workers' health by preventing occupational diseases and reducing the likelihood of workplace accidents to an acceptable level.
The reference legislation in Italy is Legislative Decree 81/08.
Among the main obligations of the Employer set forth in Legislative Decree 81/08 are risk assessment and worker training.
Drafting of DVR Risk Assessment Document
The preparation of a risk assessment document (Article 28 of Legislative Decree 81/08), commonly known as a DVR, is an obligation imposed on employers of all Italian companies, regardless of their ATECO risk classification, the number of employees, and the type of work performed.
Until May 31, 2013, companies with fewer than ten employees could consider the obligation to prepare a Risk Assessment Report (RAR) to be fulfilled simply by submitting a self-certification attesting that they had conducted an internal risk assessment. However, starting June 1, 2013, the requirement to prepare a Risk Assessment Report (RAR) was extended to all companies with only one employee other than the employer, regardless of the type of contract (for example, even if the employee is an intern, trainee, or scholarship recipient).
Therefore, only self-employed professionals, sole proprietorships, and family businesses without employees, as well as companies with a single working partner and no employees, are exempt from this obligation, with the exception of Simple Partnerships (SS) and General Partnerships (SNC), which are always required to draw up the DVR.
Appointment of competent doctor Appointment of occupational doctor
The Competent Doctor must be appointed in the cases provided for by current legislation; more specifically, in all those companies whose employees are subject to specific health risks listed in Legislative Decree 81/08.

Verification of electrical grounding systems DM 37/08
Presidential Decree 462/2001 (Article 2, paragraphs 2 and 3) requires the employer to send, within thirty days of commissioning the electrical system, the declaration of conformity to ISPESL and the territorially competent ASL or ARPA, or to the one-stop shop for productive activities in the municipalities or associations where it has been activated.
The employer (Legislative Decree 81/2008 Title III Chapter III) has the obligation to ensure that the safety requirements of electrical systems are maintained efficient during their operation.
In order to keep the systems efficient, the employer must therefore ensure regular maintenance of the electrical grounding systems, the devices for protection against atmospheric discharges, and the electrical systems in places with a risk of explosion.
